These Terms of Use outline the conditions under which you may access and interact with the National Film and Sound Archive of Australia’s (NFSA) website, subdomains, NFSA Player and digital platforms operated by the NFSA. By using this website, you agree to comply with these Terms of Use, which are designed to protect the integrity of the NFSA collection, respect the rights of creators and communities, and ensure a safe and respectful environment for all users.

1. Copyright and Use of Content

Website design, content and metadata are protected by copyright. To the extent that the NFSA owns copyright in material included on this site, you may link to these pages, download, display, print and reproduce this material in unaltered form (retaining this notice) for your personal, non-commercial or educational use.

You must not use automated tools, scripts, bots, or web crawlers to access, copy, index, or download content from NFSA websites or digital platforms without prior written permission. Examples include:

  • Bulk downloading of files or data;
  • Automated scraping of text, images, or audiovisual content;
  • Circumventing technical measures designed to protect NFSA systems or content.

2. Children and Young Users

The NFSA is committed to providing a safe and respectful online environment for all users, including children and young people.

The NFSA collection represents a wide breadth of Australian audiovisual history that may include material that could be distressing for some audiences due to historical or cultural context.

We encourage parental or guardian supervision when children access our website or our posts on social media platforms.

Material published online is assessed as part of the editorial process for its suitability to younger audiences. Where possible, we provide content warnings or classifications.

Films available for audiences are classified through the Australian Classification system prior to exhibition, by the film’s distributors. Any film without distribution can be classified by relevant NFSA staff, who have received training from the Classification Board to do so. When an excerpted film is classified as not being intended for younger audiences, consideration will be given to selecting an excerpt that is suitable. Content that is made available as pay-on-demand through platforms such as NFSA Player is made available to people over the age of 18.

3. User Accounts and Registration

Some NFSA services require you to create an account. By registering, you agree to:

  • provide accurate and current information;
  • keep your login credentials secure;
  • accept responsibility for all activity under your account;
  • not create registration accounts for the purpose of abusing the functionality of nfsa.gov.au, or other users;
  • not impersonate another person or create multiple accounts for or on behalf of a suspended user.

User accounts can be created using existing login credentials for other services such as Google, Apple and LinkedIn. By choosing this option you will be prompted to agree to sharing specific information with the NFSA. The NFSA will only use name and email in these instances and will not use or store any other information.

“Your Stuff” on the NFSA’s website allows you to create an account name, your own lists and to share them. Inappropriate use of this function is against our terms of use. Please refer to User Conduct and Community Guidelines.

We reserve the right to suspend or terminate accounts which breach these Terms of Use.

4. User Conduct – Your Stuff

The NFSA website allows users to create a Your Stuff account, and to organise content and collection items into shareable lists. The NFSA may refuse registration to users whose suggested account names are considered inappropriate, who are impersonating another person or who are attempting to create multiple accounts for or on behalf of a suspended member.

We reserve the right to edit and/or remove login names or list titles if the NFSA considers that the content:

  • is defamatory, abusive, threatening, offensive, obscene, racist, homophobic, sexist or otherwise objectionable;
  • is false or misleading;
  • violates any laws including laws regarding harassment, discrimination, racial vilification, privacy or contempt;
  • infringes intellectual property rights;
  • is spam, or promotes commercial products or services.

The NFSA may also block accounts which breach these guidelines.

5. Privacy

The NFSA is committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

We may collect personal information when you interact with our websites and platforms, register for services, or contact us. This information is used to provide services, respond to enquiries, and improve user experience.

We do not sell or rent your personal information. We may share it with trusted service providers or government agencies where required by law.

6. Cookies and similar technologies

Our website uses a range of technologies – including cookies, pixel tags, and local storage - to help us understand how visitors interact with our content and to improve your experience. We refer to all of these as “tracking technologies” in this notice.

What we mean by ‘tracking technologies’

  • First‑party and third‑party files – small data files that your browser saves to your computer, tablet, or mobile device.
  • Pixel graphics – tiny images that are used to record user behaviour and site performance.

7. NFSA Player

NFSA Player is a digital streaming service operated by the NFSA. By using the platform (including browsing, creating an account, or renting content), users agree to the NFSA Player Terms and Conditions, which form a separate agreement to these Terms of Use.

Eligibility and Account Use

  • Users must be 18 years or older and located in Australia.
  • Accounts are for personal, non-commercial use and may be shared only within a household.
  • Users are responsible for all activity under their account.

Content Access and Restrictions

  • Content is available for rent and is restricted to Australian users via geo-blocking.
  • Rental content is accessible for a limited time, as specified at transaction.

8. Social Media Community Guidelines

The NFSA welcomes public engagement with our social media channels.

We encourage thoughtful discussion, the sharing of ideas, and respectful interaction with our content and with each other. To ensure our platforms remain safe and inclusive, we may close comments on posts that have the potential to attract divisive and harmful contributions, or limit comments due to moderation resourcing. Our audience deserves a friendly space.

We reserve the right to manually hide, edit, remove or not publish user generated content and to block accounts for legal, editorial, or operational reasons. These include, but are not limited to: 

  • abusive, offensive, or unlawful content, including harassment, bullying, threats, or deliberate provocation;
  • discriminatory or hateful language, including racism, sexism, homophobia, transphobia, or other forms of prejudice;
  • obscene, explicit, or defamatory material;
  • false, misleading, or deceptive information, including impersonation, posting on behalf of suspended users or use of spam accounts;
  • allegations or accusations directed at individuals or organisations;
  • spam or repetitive content, including bot-like behaviour or off-topic posts;
  • commercial promotions, fundraising, or unsolicited advertising;
  • infringement of copyright or intellectual property rights;
  • privacy violations, including sharing personal or confidential information;
  • political commentary that promotes or criticises political parties or figures. As an Australian Government agency, the NFSA remains apolitical and does not respond to partisan commentary, though we may share relevant historical context or notable stories about Australia’s political past.

When engaging with NFSA content on third-party platforms (e.g. Facebook, Instagram, YouTube), audiences must also comply with the terms and conditions of those platforms.

Our channels are actively moderated during general business hours (AEST), Monday to Friday. Comments made outside these hours or over shutdown periods are reviewed as soon as possible during business hours.

We value the role our audiences play. If there are any concerns about inappropriate content, please contact us via enquiries@nfsa.org.au. We do not engage in direct communication via our community platforms, including voice calls.
